Terms of Service

1. Acceptance of terms

By accessing or using Linkids ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including kindergarten administrators, teachers, and parents.

2. Description of service

Linkids is a SaaS platform for kindergarten communication and management. It provides daily log tracking, announcements, media sharing, invoicing, and team management tools. The Service is available via web browser and, in future phases, mobile applications.

3. Account registration

Access to the Service is invitation-only. Kindergarten administrators are responsible for inviting staff and parents. You must provide accurate information and keep your account credentials confidential. You are responsible for all activity under your account.

4. Subscription and payment

• New accounts receive a 7-day free trial with no credit card required.
• After the trial, continued access requires a paid subscription (Starter, Professional, or Premium plan).
• Prices are listed on our website and may be changed with 30 days' notice.
• Subscriptions are per kindergarten location, not per user.
• There are no refunds for partial billing periods.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload content that violates any third-party rights, including children's privacy rights.
• Attempt to gain unauthorised access to other accounts or kindergarten data.
• Interfere with or disrupt the integrity or performance of the Service.
• Share children's personal data or media without appropriate parental consent.

6. Data and GDPR

Linkids acts as a data processor on behalf of each kindergarten (the data controller) for child and parent data. Kindergarten administrators are responsible for obtaining appropriate consents from parents and complying with GDPR in their jurisdiction. Our data practices are described in our Privacy Policy.

7. Media and content

You retain ownership of content you upload. By uploading media, you grant Linkids a limited licence to store and display it to authorised users of your kindergarten account. Media shared via the platform is governed by the child's consent flag set by the administrator. You are responsible for ensuring media consent is valid before uploading.

8. Termination

Either party may terminate the subscription at any time. Upon termination, access to the Service will cease at the end of the current billing period. Account data will be retained for 30 days after termination and then permanently deleted. We reserve the right to suspend accounts that violate these terms without notice.

9. Limitation of liability

The Service is provided "as is". To the maximum extent permitted by law, Linkids shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the fees paid by you in the 3 months preceding the claim.

10. Changes to terms

We may update these terms at any time. Material changes will be communicated to administrators by email with at least 14 days' notice. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.
